Potential Changes to DOLS legislation and survey

The draft Mental Capacity Amendment Bill was announced on 4 July (https://services.parliament.uk/bills/2017-19/mentalcapacityamendment.html ). This abolishes DOLS by deleting Mental Capacity Act 2005 (MCA) Schedule A1 and 1A, and adds instead a new Schedule AA1 – which we anticipate will be known as the Liberty Protection Safeguards (LPS), as proposed by the Law Commission in March 2017. The key elements are as follows:

  • there is no statutory definition of DoL – so the Cheshire West supreme court judgement from March 2014 (and so the very wide scope of people currently caught) prevails
  • MCA s4B is revised – implementing a new and wider definition of life sustaining treatment / vital act emergency circumstances in which a DoL will be lawful, pending any formal authorisation
  • there is a new special procedure for care homes, basically giving them great responsibility for arranging the assessments
  • in the case of care homes, these assessments and consultation and advocacy referral will be carried out by the care home manager
  • a statement is to be provided by the care home to the Responsible Body (RB) to confirm all conditions are met and consultation carried out – this must include a record of assessments, evidence of consultation, a draft authorisation record
  • when the RB authorises the arrangements, the draft record becomes the authorisation record
  • regular reviews must be carried out by the care home
  • hospitals (both NHS and independent sector) will become responsible for authorising their own DoLs
  • DoL in other settings will be the responsibility for authorisation of the CCG (if CHC funded) or the relevant local authority in all other cases
  • for a DoL to be authorised, it must be “necessary and proportionate”, as determined by the hospital or care home manager, after specified appropriate consultation
  • an Approved Mental Capacity Professional will bring independent scrutiny, but only where “it is reasonable to believe that the person cared for does not wish to reside in that place …or to receive that care” – i.e. effectively only in the case of “objection” by the patient / service user
  • authorisations of a DoL may last for up to 12 months initially, and can then be renewed for up to 12 months, but subsequent renewals can be for up to 3 years
  • the Court of Protection continues to have jurisdiction over any appeal against an authorisation of a DoL.

On the timescales, we understand that it is anticipated that the Bill will be out of the Lords by the end of November 2018, and through the Commons early next year, with Royal Assent perhaps by April 2019. Allowing for implementation and training, we might expect it to come into force perhaps in late 2019 / early 2020. We need to be made aware of the new responsibilities being imposed on care homes, CCGs and hospitals, which will have obvious implications on resources and training.

Edge Training in conjunction with Community Care have created a survey on the Liberty Protection Safeguards (LPS) which are due to replace DOLS. The survey is designed to provide evidence for the House of Lords and House of Commons about what people think about LPS. It is an opportunity to give your views and inform parliamentarians on the changes that could or should be made to it before it becomes law. Following lobbying from a number of groups (notably charities) some potential amendments have already been tabled in the House of Lords.
